On 4 May 2023, the Labour Court handed down a Judgment reviewing and setting aside the Minister’s decision (taken on 18 June 2021) to extend the 2021/2022 SARPBAC Main Collective Agreement (concluded on 22 April 2021) to non-parties. The 2021/2022 Main Collective Agreement in any event expired in 2022 when it was replaced by the 2022/2023 Main Collective Agreement.
SARPBAC has applied for leave to appeal the Labour Court Judgment, which application has the effect of suspending the operation of the Judgment until the appeal is decided. Accordingly, the 2021/2022 Main Collective Agreement, albeit expired, in any event remains fully enforceable against non-parties (and parties) to SARPBAC.
